Item Discussion

Whereas, The Minneapolis Park and Recreation Board (MPRB) is authorized to contract with public and private entities in the performance of its functions;

 

Whereas, In July of 2016, the MPRB authorized use of the Hennepin County purchasing contract HC3295A1 for the construction scope category CC2.1 - Mechanical Work for the Minneapolis Sculpture Garden Reconstruction Project for services to be provided by Northern Air Corporation Mechanical and Electrical Services, in the amount of $170,420.00;

 

Whereas, State of Minnesota Statute 471.59 Joint Exercise of Powers authorizes the use of intergovernmental purchasing and allows one government agency to purchase from contracts such as the Hennepin County Contract competitively solicited by another government agency;

 

Whereas, Change Order Number One in the total amount of $21,790.81, provides for necessary plumbing main changes, temperature sensors and alarms, and removal of conservatory utility items;

 

Whereas, MPRB Staff and the project consultants have reviewed the costs related to Change Order Number One and determined that the costs are prudent and appropriate; and

 

Whereas, This resolution is supported by the MPRB 2007-2020 Comprehensive Plan, which envisions “Dynamic parks that shape city character and meet diverse community needs;”

 

RESOLVED, That the Board of Commissioners approves Change Order Number One (1) with Northern Air Corporation Mechanical and Electrical Services, for the Minneapolis Sculpture Garden Reconstruction Project under Hennepin County Contract HC3295A1 in the total amount of $21,790.81 for a new contract total of $192,210.81; and

 

RESOLVED, That the President of the Board and Secretary to the Board are authorized to take all necessary administrative actions to implement this resolution.

Background

 

This Board action considers approval of Change Order Number One with Northern Air Corporation (NAC) Mechanical and Electrical Services, for the Minneapolis Sculpture Garden Reconstruction Project in the amount of $21,790.81 for a new contract total of $192,210.81 (Attachment A). The proposed changes added value to the project and represented a prudent use of project funding. The Board approved contingency for this contract was 10% of the overall Contract Amount for the work, or $17,042.00.  This Change Order exceeds the Board approved contingency.

 

On March 14, 2016, the Minneapolis Park & Recreation Board (MPRB) publicly solicited, yet received no bids for the Construction Contract Category CC2.1 of the Minneapolis Sculpture Garden Reconstruction Project.  Planning staff researched alternative delivery methods for completion of the mechanical work, which needed to be completed on schedule with the other Bid Categories, for which Bids had been received, under the Multi-Prime Contractor delivery method. 

 

Since the Minnesota Legislature has encouraged and fostered local intergovernmental cooperative action by enacting State of Minnesota Statute 471.59 Joint Exercise of Powers, MPRB was allowed to use intergovernmental purchasing and cooperation to contract for this work.  Therefore, in July 2016, MPRB approved and entered into a Joint Powers agreement, under Hennepin County Contract HC3295A1, a competitively solicited time and materials mechanical and electrical contract, for the mechanical work for the Minneapolis Sculpture Garden Reconstruction Project for $170,420.00, and authorizing the use of a 10% construction contingency up to $17,042.00 for necessary construction change orders that may arise with the contract. Since the changer order exceeds the 10% construction contingency, Board approval is required. There are available funds to cover the cost of the change order.
