Whereas, The Minneapolis Park & Recreation Board (MPRB) is authorized to contract with public and private entities in the performance of its functions;

Whereas, The Board of Commissioners entered into Professional Services Agreement #C-40544 with Stantec Consulting Services, Inc. (Stantec) on March 2, 2016 for $141,200;

Whereas, The Professional Services Agreement was amended the first time for additional services on July 20, 2016 in the amount of $10,000 for a new contract amount of $151,200;

Whereas, Bids received on June 30, 2016 for Bryant Square Park and Logan Park Wading Pool Improvements were rejected due to a budget shortfall;

Whereas, The Professional Services Agreement with Stantec was amended a second time on January 4, 2017 to revise the construction documents for re-bidding and for additional in-construction services in an amount of $15,500, for a new contract amount of $166,700.00;

Whereas, The project was be re-bid in January 2017 after additional CIP funding was identified, with bids being received on February 15, 2017, and a construction contract awarded to LS Black Constructors Inc. for construction of Bryant Square Park pool, for a contract amount of $699,200.00;

Whereas, The ADA Transition Plan identified specific site access and circulation deficiencies at Bryant Square Park and given the new playground and wading pool improvements were designed to meet current ADA standards, staff determined it necessary to amend the Professional Services Agreement with Stantec to provide design and construction oversight services to address non-compliant circulation areas which were outside the project area, and beyond Stantec’s original scope for the wading pool;

Whereas, The contract with Stantec Consulting, Inc. was amended a third time to provide for these additional ADA services, with a fee not to exceed $8,000.00, for a new contract amount of $174,700.00;

Whereas, Because the 20-Year Neighborhood Park Plan allocates funding annually for accessibility improvements, funding is sufficient to cover fees for these additional design and construction oversight services;

Whereas, The additional CIP funding added in 2017 was only allocated to Bryant Square Park and not Logan Park; thus, when the project was subsequently re-bid with Bryant Square Park wading pool as the base bid and Logan Park wading pool as add alternate, a contract was awarded to LS Black Constructors for acceptance of their base bid only;

Whereas, In order to be able to re-bid the wading pool improvements at Logan Park, revisions to the construction documents are required to make it a stand-alone project; therefore it is necessary to amend the Professional Services Agreement with Stantec a fourth time for re-design, re-bidding and additional in-construction services in an amount of $16,500, for a new contract amount of $191,200.00; and

Whereas, This resolution is supported by the MPRB 2007-2020 Comprehensive Plan, which envisions “Dynamic parks that shape city character and meet diverse community needs;”

RESOLVED, That the Board of Commissioners approves Amendment No. 4 to Professional Services Agreement #C-40544 with Stantec Consulting Services, Inc. for additional services related to wading pool improvements at Bryant Square Park and Logan Park for an amount not to exceed $16,500, for a new contract total of $191,200; and

 

RESOLVED, That the President of the Board and Secretary to the Board are authorized to take all necessary administrative actions to implement this Resolution.

Background

This resolution considers a fourth amendment to Professional Services Agreement #C-40544 with Stantec Consulting Services, Inc. (Stantec) for a fee not to exceed $16,500 for re-design, re-bidding and additional construction oversight related to wading pool improvements at Bryant Square Park and Logan Park (Attachment A).

 

The original contract with Stantec for engineering and other consulting services related to the replacement of wading pools at Bryant Square Park and Logan Park was in the amount of $141,200.  The first amendment for additional services in the amount of $10,000 addressed hydraulic modeling and design to meet requirements of Minnehaha Creek Watershed District related to storm water management at Bryant Square Park; coordination with Braun Intertec to address disposal of contaminated soils discovered at Bryant Square Park, and incorporation of site modifications at Logan Park in the construction drawings to create an accessible route to the wading pool from the parking lot.

 

The project was bid for construction in June 2016, but bids exceeded available project funding and thus were rejected.  The Professional Services Agreement (PSA) with Stantec was amended a second time in an amount not to exceed $15,500 so that Stantec could revise the construction documents such that the project could be re-bid.  Additional funding for the project was identified in the 2017 Capital Improvement Plan. 

 

The ADA Transition Audit prepared for the MPRB identified non-compliant site circulation deficiencies at Bryant Square Park.  The new playground and wading pool were designed to meet ADA guidelines; however, access to them was never considered in any design scope of services.  To address access, the Professional Services Agreement with Stantec was amended a third time in an amount not to exceed $8,000 to provide the necessary design and construction oversight services for non-compliant site circulation areas at Bryant Square Park, which were outside of Stantec’s original scope for the wading pool.  These additional services assist with providing ADA access from the parking lot to the building as well as over to the wading pool and playground.  Funding sufficient to cover fees for the additional design and construction oversight services is available through NPP20 Rehabilitation funding.

 

When LS Black Constructors was awarded the construction contract it was only for acceptance of its Base Bid, to construct the wading pool at Bryant Square Park, and did not include acceptance of add alternate No. 1, which was construction of the wading pool at Logan Park, as the additional CIP funding added in 2017 was only allocated to Bryant Square Park.  To be able to separate out and re-bid the wading pool improvements at Logan Park, revisions to the construction documents are required.  It is necessary to amend the Professional Services Agreement with Stantec a fourth time for re-design, re-bidding and additional in-construction services in an amount not to exceed $16,500.

 

Staff has reviewed the proposed scope and related fees and has determined that they are appropriate and necessary for the project to advance.
